Purchase – sale rules

  1. General provisions.
    1. These Rules of Purchase and Sale of Goods (hereinafter referred to as the “Rules”) are a legal document binding on the parties, which establishes the rights and obligations of the Buyer and the Seller, conditions of purchase and payment for goods, delivery and return procedures, liability of the parties and other related provisions in the My Fairytale online store.
    2. By placing an order, the Buyer confirms that he agrees with these Rules.
    3. The Agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer has formed a shopping cart in the online store, indicated the delivery address, selected the payment method and read the Rules, click the “Buy” button.
  2. Protection of personal data.
    1. When ordering goods in the online store “My Fairytale”, the buyer must provide the data requested at the time of purchase: name, surname, address and e-mail address.
    2. The buyer is responsible for providing correct data at the time of purchase.
    3. By placing an order, the Buyer agrees that the personal data provided by him will be processed for the purposes of order execution.
    4. The Buyer also agrees that the e-mail specified by the Buyer information messages necessary to fulfill the order of goods would be sent to the e-mail address.
    5. The Buyer’s personal data may be processed for marketing purposes only with the Buyer’s own consent. The Seller undertakes not to disclose the Buyer’s personal data to third parties, except when required by the competent State authority in the cases provided by the laws of the Republic of Lithuania or with the separate written consent of the Buyer.
  3. Buyer’s rights and obligations.
    1. The Buyer undertakes to pay the Seller the agreed amount for the ordered goods and to accept them.
    2. Provide complete, complete and correct information on the billing form. If the Buyer provides inaccurate, false or misleading data in the payment form, My Fairytale has the right to cancel the Buyer’s registration and delete the data.
    3. In the event of a change in the Buyer’s data provided in the purchase form, the Buyer must immediately inform the Seller.
    4. The Buyer has the right to withdraw from the contract of purchase and sale of goods in accordance with the provisions set forth in the Rules of Return of Goods.
    5. By placing an order in the online store “My Fairytale”, the Buyer agrees with these Purchase and Sale Rules and undertakes to comply with them and the established legal acts of the Republic of Lithuania.
  4. Rights and obligations of the seller.
    1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the online store “My Fairytale”.
    2. If the Buyer tries to damage the stability and security of the online store or violates its obligations, the Seller has the right to immediately and without notice restrict, suspend or revoke the Buyer’s access to the online store.
    3. The Seller undertakes to respect the Buyer’s right to privacy of the personal information belonging to the Buyer specified in the purchase form and not to transfer it to third parties.
    4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
    5. The Seller may, in important circumstances, temporarily or permanently terminate the operation of the online store without notifying the Buyer in advance.
    6. The Seller may unilaterally change the terms of these Rules.
    7. If the Buyer uses the services provided by My Fairytale after the changes in these terms and conditions, it is considered that the Buyer has agreed to the change of the Rules.
  5. Ordering goods, prices, payment procedure, and terms.
    1. In the online store, the Buyer can buy online 7 days a week, 24 hours a day. Of day.
    2. Orders are accepted only using the online store “My Fairytale”.
    3. All product prices in the online store are in euros.
    4. After choosing the payment method “Bank transfer”, the buyer undertakes to pay for the order within 2 (two) calendar days from the day of order confirmation. The preparation of the parcel starts only after receiving the payment for the goods.
    5. If the buyer fails to make the payment within 2 calendar days, the order will be canceled.
  6. Delivery of goods.
    1. The buyer undertakes to indicate the exact place of delivery of the goods.
    2. The buyer undertakes to accept the goods himself. In the event that the Buyer is unable to accept the goods himself and the goods are delivered to the specified address, the Buyer shall not have the right to make claims to the Seller regarding the delivery of the goods to the wrong entity.
    3. The goods are sent to the Buyer within 1-5 working days from the confirmation of payment, unless otherwise specified in the description of the goods.
    4. In all cases, the Seller is released from liability for non-compliance with the terms of delivery of goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Seller’s control.
    5. The Buyer must immediately inform the Seller if the consignment is received in a damaged package, if the consignment receives unsolicited goods or an incorrect quantity, incomplete goods.
    6. The buyer must e-mail provide the Seller by post with photos of the damaged parcel and/or product.
    7. The Goods are delivered to the Buyer within 1-3 working days after the day of dispatch of the goods, using the services of third parties (companies providing delivery services).
  7. Product quality, guarantees.
    1. All data of the goods sold in the online store “My Fairytale” are indicated in the product description attached to each product.
    2. The quantities of goods shown in the store in the photos are not always related to the price of the goods – the price of more than one unit of goods may be displayed. The units of measurement are specified in the product description. The color of the goods may vary slightly depending on the monitor used by the Buyer.
    3. The seller may provide an appropriate quality guarantee for individual types of goods, the specific term and other conditions of which are specified in the description of the goods.
  8. Marketing and information.
    1. The seller can organize various promotions and offers in the online store “My Fairytale”.
    2. The seller has the right to unilaterally, without separate notice, change the terms of the shares, as well as cancel them. Any change or cancellation of the terms and conditions of the shares shall take effect from the moment of their change or cancellation.
    3. The Seller sends notifications to the Buyer to the e-mail address specified in the Buyer’s purchase form.
    4. . The Buyer sends all notifications and questions to the Seller’s e-mail. the contacts listed in the “Contacts” section of the store.
    5. The Seller shall not be liable if the Buyer does not receive the sent informational or confirmatory messages due to internet connection, e-mail service provider network failures, messages entering the SPAM catalog, or due to incorrect data provided by the Buyer.
    6. The Buyer’s personal data may be processed for marketing purposes under the conditions specified in Clause 2.4 of these Rules.
  9. Final Provisions.
    1. These Rules of Purchase and Sale of Goods have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania.
    2. The law of the Republic of Lithuania applies to these rules. All disputes arising out of the application of these rules shall be settled by negotiation. If no agreement is reached, disagreements are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
